Question by : Is it legal for kids under 18 to do affiliate marketing? I am under 18 and really want to make a information website and make money from affiliate programs and ads. You can do it but better opt for the nominee of your payment to be above 18 because the only problem under age is the income tax if you earn too much than the limit specified. Hi Andrew, I did some searching for you and came up with the following: How can a minor form a business entity? If a parent chooses to form the business on behalf of their child, they can act as an authorized signer. Liabilities apply in these situations, and parents can be held responsible if their dependent is negligent in matters of operating the business. It's a good idea for parents to consult with an attorney and certified public accountant (CPA). Can a minor claim copyright? According to Copyright.gov, "minors may claim copyright, and the Copyright Office issues registrations to minors, but state laws may regulate the business dealings involving copyrights owned by minors." Copyright.gov advises that you consult a local attorney for specific guidance. Can a minor sign a contract? Technically, yes, a minor can sign a contract, but because minors are not considered to have the legal competency to enter into a binding agreement, they have ability to "disaffirm*" the contract - which essentially voids their end of the bargain. In most states, people under the age of 18 are considered minors. If I may, I can recommend an affiliate training program that is 2nd to none. Top quality and very professional. Most don't know this but every affiliate marketer who has his own website is required to use some legal documents to run his business. These are important to have so that you don't risk losing everything you've worked for. It only takes a single complaint from a customer to shutdown your entire business. Every business has these documents which are just extra pages added to your website. Most people add these links to the extra pages of documents to the bottom of their homepage which can be found at the very bottom of the page. Most all websites have a privacy policy document, a terms of use disclaimer,a copyright notice and some also have an earning disclaimer if they are any type of work form home business.

These are things you will need in order to protect yourself and your business.

This is a typical document that every website owner needs in order to protect himself.  this document describes how you are collecting and using your visitors information. It should clearly indicate that you will not use the information of your visitors for any other purposes and you will not share their personal information. The Federal Trade Commission requires that all website owners have this on their website.

2. Terms of Use & Disclaimer

These two document will limit your responsibility to your website users and will protect you. This document usually contains Use of Site, licenses, limitation of liability,  etc.


3. Copyright Notice

Copyright notice is solely for your own protection against people who might want to copy your website, graphics or content. It specifies how the content can be used by others, what is permitted and what is not by the site owner himself - You. If you don't want anyone to copy your website content, you should indicate it in copyright notices. Without this notice, people may steal your website content and graphics. You can also state that anyone who would like to use your graphics or content will need specific permission from you first. Otherwise, he is breaking the copyright laws and he may be sued for that. If you want to allow people to use you website information, then you should make it very clear in your copyright notice.

4. Earnings Disclaimer

If you are selling any information or running any type of business opportunity where there is money to be earned, you will need this document. Without this document your business may be shut down by FTC.
